Two tiers of government
Who keeps the records on a Muskoka cottage
Muskoka has two levels of local government: the District Municipality of Muskoka, and six area municipalities under it (Bracebridge, Gravenhurst, Huntsville, Lake of Bays, Muskoka Lakes and Georgian Bay). Knowing which one holds a record saves weeks in a short condition period. The general rules for wells, septic and access in Ontario are on our cottage property page.

Your town or township
- Septic permits, and the results of its septic maintenance inspection program
- Building permits, including, in Muskoka Lakes, structural repairs to dock cribs and stringers
- Closing and selling the shore road allowance in front of the lot
- Zoning, and short-term rental licences in Muskoka Lakes, Gravenhurst and Huntsville
- Township roads, which in Muskoka Lakes are kept to a snow-packed surface in winter
The District of Muskoka
- District roads, the numbered Muskoka Roads, kept to bare pavement in winter
- The Muskoka Official Plan; as of October 2026 its lake system health policies are being updated through Official Plan Amendment 61
- Neither tier plows a private road: the owners who use it arrange and pay for that themselves
The province, Ottawa and the court
- The Ministry of Natural Resources: a work permit for structures touching more than 15 m² of shore lands
- Parks Canada, on Sparrow Lake and the Severn River in Gravenhurst, which are part of the Trent–Severn Waterway
- The Superior Court of Justice in Bracebridge, but only for estates of people who lived in Muskoka; a GTA owner’s estate is filed at home
Ask the seller early for the township’s septic and permit records; we tell you which office to ask for what is missing. If the cottage sits on a private road, ask who plows it and whether there is a written road agreement.
Septic inspections
The township may already have inspected the septic
Most Muskoka cottages are on a private septic system, and several of the area municipalities inspect existing systems on their own schedule. A buyer who asks for those results knows more than a buyer who relies on the listing.

Muskoka Lakes
The Township has run septic re-inspections since 2000 and now sorts more than 10,000 systems by risk under its Sewage System Maintenance Inspection Program. Waterfront systems 10 to 30 years old get a short visual Phase I inspection by Township staff. Waterfront systems over 30 years old, systems with no permit on file, and systems serving a short-term rental are high risk and need a Phase II inspection by a qualified inspector, at the owner’s cost ($340 or $355 through the Township’s partner as of 2026). Inspections run zone by zone, so ask the seller which phase the cottage has had, for the report, and whether any repair was ordered and finished.
Bracebridge
The Town runs a mandatory septic maintenance inspection program, with a more detailed Phase 2 inspection by a qualified professional where a system is older or high risk. Installing, replacing or repairing a system needs a permit from the Town.
Huntsville
Huntsville’s building department runs a discretionary inspection program under a Council policy approved in November 2022. Not every property will have been inspected; ask whether this one has.
Georgian Bay Township, Gravenhurst and Lake of Bays
The Township of Georgian Bay must re-inspect systems within 1 km of the municipal water intakes at Port Severn and MacTier every five years, and inspects other waterfront properties, including water-access ones, at its discretion. In Gravenhurst and Lake of Bays, ask the building department what it has on file.
What a municipal inspection doesn’t tell you
A maintenance inspection checks that the system works and isn’t polluting. It doesn’t tell you whether the system is big enough for the bedrooms you plan to add, or for renting the cottage out. We write the agreement so the seller hands over the municipal results and any orders, and you keep a condition for your own inspection.

Shoreline
Shore road allowances and boathouses, town by town
Many Muskoka lots, island lots on Lake Muskoka included, were surveyed with a shore road allowance, usually 66 feet wide, between the lot and the water. Each municipality sells them on its own terms, and the process takes months: a survey, a public notice and a by-law. It rarely finishes before closing, so the agreement has to deal with it.

Muskoka Lakes
Under the Township’s shore road allowance policy, only the abutting owner can buy, and only the whole frontage between the side lot lines extended to the water. The flooded part has to be bought with the dry part. The price is set per square foot in the Township’s fees by-law, and the applicant pays the survey and legal costs. The point buyers miss: you must buy the open allowance before the Township will take a building permit application for any building on it or between it and the water. A dock is the only exception. If you plan to rebuild a boathouse or extend the cottage toward the lake, the allowance comes first.
Gravenhurst
The Town’s 2025 closing procedures charge a $974 application fee, a $3,500 retainer for the Town’s solicitor, and a price of $91 per running foot of shoreline on Lake Muskoka and $67 on other lakes, plus HST, as of 2026. The Town won’t close an allowance where a public road runs between the lot and the allowance.
Huntsville
Huntsville makes buying the allowance a condition of planning approval for a waterfront owner who wants to develop. The Town’s application costs $1,187 with a $2,650 legal deposit, the land is priced per square metre, and the survey must show the flooded and unflooded parts.
Bracebridge
Bracebridge Council closes and sells allowances by by-law after a public notice, including on island lots such as those on Browning Island. Ask the Town’s land and agreements staff about the current process and price.
Docks and boathouses
Since June 1, 2017, the Ministry of Natural Resources no longer issues occupational authority for docks and single-storey boathouses used only for boat storage. A two-storey boathouse, or one with living space or a sauna, still needs it, for a fee. Ask the seller for it, and for the building permits: Muskoka Lakes requires a permit even for structural repairs to dock cribs and stringers, and Gravenhurst’s shoreline structures permit asks for the provincial or Trent–Severn approval first. On Sparrow Lake and the Severn River, Parks Canada owns the bed and requires an in-water and shoreline works permit for any work on, under or over it.
Questions
Muskoka cottage questions

Do you have an office in Muskoka?
No. Our only office is in Toronto, Toronto. An Ontario lawyer can act on a property anywhere in the province, and land registration is electronic. We review the documents with you by video while you sign on paper and courier the originals to us, or you sign at our office.
Can I rent the cottage out after I buy it?
Only with a licence in Muskoka Lakes, Gravenhurst and Huntsville. In Huntsville you must own the property for one full year before you can apply, licences are capped at 250, and the seller’s licence doesn’t transfer to you. Muskoka Lakes licenses stays of 28 days or less under By-law 2025-049. Gravenhurst issues licences for one calendar year, charges a 4% municipal accommodation tax, and can refuse a licence over septic capacity. Check the Huntsville, Muskoka Lakes or Gravenhurst rules before you count rental income in your budget.
The seller says the township inspected the septic. Is that enough?
It is a good start, not a substitute. Ask for the report and any order to repair. A municipal inspection checks that the system works; it doesn’t confirm the system suits the use you plan. Keep your own inspection condition.
The boathouse has a bedroom upstairs. What should we check?
Ask for the building permits and the Ministry of Natural Resources occupational authority, which a two-storey boathouse or one with living space still needs. Check whether it sits on an unsold shore road allowance. In Muskoka Lakes, any rebuilding needs the allowance bought first.
Where is probate filed for a Muskoka cottage?
Where the owner lived, not where the cottage is. A GTA owner’s estate is filed with the Superior Court in their home region, such as Toronto, even if the cottage is the main asset. The Bracebridge courthouse, 3A Dominion Street, handles estates of people who lived in Muskoka, and of owners who lived outside Ontario and owned property there (see applying for probate). Our probate page explains the process.
Is the Township of Georgian Bay covered here?
Its Muskoka side is: it is part of the District, its estates go to Bracebridge, and its septic program is described above. For island and open-water properties on the Georgian Bay coast, see our Parry Sound and Georgian Bay page.
How much does a Muskoka cottage closing cost?
It is quoted after we see the property details. Our standard residential fee covers a home on city services; a cottage with a septic system, a well, a private road or a shore road allowance needs more work, and we tell you the fee before you retain us. Start a quote or book a free 15-minute call.
