Whitby at a glance

A growing Durham town, north and south of the 407

Whitby runs from the lakeshore at Port Whitby, through the historic downtown, to Brooklin, north of Highway 407, and the rural land beyond it. Much of its new housing is in Brooklin.

Homes

The Town has changed its by-laws to allow up to four units on a residential lot, so more resale houses now come with a second unit, and more buyers are signing with builders. Whitby has no municipal land transfer tax: you pay Ontario’s tax only, about $15,475 on a $950,000 home (as of 2026). Cooling-off rights for new homes and the first-time buyer refund are explained on our Whitby real estate page.

Families and estates

Rural properties and family cottages raise questions a city condo doesn’t, such as who takes over the land and how it is shared. When a Whitby resident dies, the probate application goes to the Superior Court of Justice for Durham Region at the Oshawa courthouse, and it can be filed by email. Probate for Whitby estates
